These Terms and Conditions apply to all CBPTC enrolments. Payment of the invoice constitutes acceptance.

1. Parties and Definitions

Strait Point	Strait Point Pty Ltd (ABN: 66 695 550 399), trading as Strait Point, the registered course provider and AMSA-licensed pilotage training organisation.
Participant	The individual registered to attend the CBPTC, whether self-funded or employer-sponsored.
Sponsoring Employer	Any company, port authority, or government body paying fees on behalf of a Participant.
CBPTC	The Competency-Based Pilot Training Course - a 10-day intensive course delivered by Strait Point under AMSA approval.
Course Fees	All amounts payable for course attendance, including tuition, simulator access, and materials fees.
Working Days	Monday to Friday, excluding Queensland public holidays.
ACL	Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)).
GST	Goods and Services Tax as defined under A New Tax System (Goods and Services Tax) Act 1999 (Cth).
Invoice	The tax invoice issued by Strait Point confirming the Participant's place and the Course Fees payable.

2. Registration and Enrolment

2.1 How to Register
Registration is by email to training@straitpoint.com.au. Strait Point will respond confirming availability and issue an invoice. A place is not confirmed until payment is received in full. Strait Point reserves the right to decline any registration without providing reasons.

2.2 Entry Prerequisites
All Participants must satisfy the published entry prerequisites before attending. Strait Point may request supporting documentation at any time. If a Participant does not satisfy prerequisites, Strait Point may withdraw the Participant and clause 4 cancellation provisions apply.

3. Course Fees, GST and Payment

3.1 Fees - All fees are quoted in Australian Dollars (AUD) as published on the Strait Point website or confirmed in writing at registration.

3.2 GST - Course Fees are subject to GST. Tax invoices will be issued accordingly. Any GST refund entitlement for overseas-resident Participants is a matter between the Participant and the ATO.

3.3 Payment - Your place is confirmed only upon receipt of full payment. Until full payment is received, Strait Point may allocate the place to another candidate without notice. There is no deposit.

3.4 Accepted Payment Methods - Payment is accepted by bank transfer (EFT). Full bank account details are provided on the invoice. A $500 non-refundable administration fee applies to all enrolments. Invoices not settled by the due date may attract a late payment fee of 2% per month.

4. Cancellations and Transfers

All cancellations must be in writing to training@straitpoint.com.au. The sole exception is if Strait Point cancels the course entirely (clause 5). Participants are strongly advised to book travel and accommodation on a fully refundable basis. Strait Point accepts no liability for travel, accommodation, flights, visa, or related costs under any circumstances.

4.2 Transfers - One complimentary transfer to a future intake is available if written notice is received 14+ calendar days before the course. Transfers with less than 14 days' notice are not permitted; cancellation terms apply.

4.3 Substitutions - A registered Participant may be substituted by a replacement nominee who satisfies all entry prerequisites. Written notice required at least 5 Working Days before commencement. A $500 substitution administration fee applies.

5. Cancellation or Variation by Strait Point

Strait Point reserves the right to cancel, postpone, or modify any course where minimum enrolment numbers are not met; a key instructor becomes unavailable within 10 Working Days; or circumstances beyond reasonable control prevent safe or compliant delivery. Strait Point will provide minimum 15 Working Days' notice where practicable. Where Strait Point cancels prior to commencement, Participants receive a full refund or may transfer to the next intake at no cost. Liability is limited to Course Fees actually paid.

6. Attendance and Participation

Unexplained absence constitutes withdrawal. Medical grounds do not exempt a Participant from the non-refund provisions of clause 4.1. Conduct - Strait Point reserves the right to remove any Participant who poses a safety risk, is under the influence of alcohol or a prohibited substance, or persistently fails to follow reasonable trainer directions. No refund is payable.

6.3 Medical and Fitness - Participants are responsible for ensuring they are medically and physically fit for all aspects, including VR bridge simulator operations at Morild Bridge. Participants will be required to sign a fitness and indemnity declaration prior to simulator sessions.

Certificates are issued within 10 Working Days of course completion to Participants who satisfy all requirements. Attendance alone does not entitle a Participant to certification. A failure to meet competency criteria does not entitle the Participant to a refund or repeat attendance. Written feedback may be requested to training@straitpoint.com.au.

10. Intellectual Property

All course materials are and remain the intellectual property of Strait Point Pty Ltd. Participants are granted a limited, non-transferable licence for personal professional development purposes only. Materials must not be reproduced or used for commercial purposes without prior written consent.

11. Confidentiality and Privacy

Personal information is collected for course administration, certification, and regulatory reporting to AMSA, and is handled under the Privacy Act 1988 (Cth). Assessment records are retained for a minimum of five years. Detailed records will not be disclosed to Sponsoring Employers without the Participant's written consent, except where required by law or AMSA.

12. Liability and Consumer Guarantees

Nothing in these Terms excludes any right or remedy under the ACL that cannot lawfully be excluded. To the extent permitted by law: Strait Point's total liability is limited to Course Fees actually paid; all liability for indirect, consequential, or incidental loss is excluded; and Strait Point is not liable for delay or failure caused by circumstances beyond its reasonable control.

13. Variations to These Terms

Strait Point reserves the right to amend these Terms at any time. The current version is published at straitpoint.com.au. Amendments do not apply retroactively to confirmed enrolments except where required by law or AMSA regulatory change.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of Queensland, Australia, subject to the non-exclusive jurisdiction of the courts of Queensland. Strait Point and the Participant will make good-faith efforts to resolve disputes through direct negotiation before commencing formal proceedings.
